1. Introduction

Magic Marketer Pty Ltd ("we", "us", "our") operates Magic Marketer® App. This Privacy Policy explains how we collect, use, disclose, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Information We Collect

We collect the following types of information:

• Account information: name, email address, business name, and role.
• Social media tokens: OAuth credentials for connected platforms (LinkedIn, Instagram, Facebook, etc.). These are used only to post on your behalf.
• Call transcripts: audio/text from calls you connect to the Service, used to generate marketing drafts. Transcripts are processed to generate your content and are not retained after a draft is produced.
• Google Calendar data (if connected): with your permission, we read calendar event metadata (time, attendees, meeting link) solely to determine when to send our meeting assistant to a call. We do not store your calendar events, and calendar data is never used to generate content or passed to any AI model.
• Content data: posts, drafts, images, and scheduling preferences you create or upload.
• Usage data: pages visited, features used, and actions taken within the Service.
• Payment information: billing details processed by Stripe; we do not store card numbers.

3. How We Use Your Information

We use your information to:

• Provide and improve the Service
• Generate personalised marketing drafts in your voice
• Schedule and publish content to connected social platforms
• Process payments and manage your subscription
• Send transactional emails (receipts, product updates, support)
• Analyse aggregate usage to improve features

We will not use your call transcripts or content data to train general AI models. Your content belongs to you.

We will not use Google user data — including Calendar data, in raw, aggregated, or derived form — to train, develop, or improve any AI or machine learning model, foundational or otherwise.

4. Sharing with Third Parties

We share your information only as necessary to provide the Service:

• Social media platforms: to publish content on your behalf via official APIs.
• Stripe: for payment processing.
• AI processing providers: for draft generation. We use Anthropic's Claude API to generate social media content from your transcripts and other inputs. Data is processed under data processing agreements and is not used to train Anthropic's models.
• Transcription providers: we use Recall.ai to transcribe calls you've connected, with participant consent obtained by you. Transcript data is used only to generate your content.
• Scheduling and analytics providers: we use a third-party publishing provider to manage scheduled publishing and to recommend optimal posting times based on your engagement analytics. Their name is available on request.
• Cloud infrastructure: for hosting and data storage (servers may be located outside Australia).

We do not sell your personal information to third parties.

5. Data Retention

We retain your personal information for as long as your account is active. Upon account cancellation, we delete your personal data within 30 days, except where we are required to retain it by law (e.g. financial records for tax purposes).

Google Calendar data is not retained — it is read at the time of scheduling only. Call transcripts are retained only as long as needed to generate your requested content and are not stored afterward; only the resulting marketing drafts are saved to your account.

6. Security

We use industry-standard security measures including encryption in transit (TLS), encrypted storage, and access controls. No system is completely secure; if you become aware of a security issue, please contact us at grow@magicmarketer.app.

7. Your Rights

Under the Australian Privacy Act, you have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate or incomplete information
• Request deletion of your account and associated data
• Complain to the Office of the Australian Information Commissioner (OAIC) if you believe your privacy rights have been breached

8. Cookies and Similar Technologies

We use cookies and similar technologies (such as pixels, tags, and local storage) on our websites and services. These fall into three groups:

• Essential cookies: required for the site and Service to work — for example, keeping you signed in, securing your session, and remembering cookie preferences. These do not require consent.
• Analytics cookies: help us understand how people use our websites (pages visited, features used, approximate location, device type) so we can improve performance and content. Providers may include Google Analytics and PostHog.
• Advertising and retargeting cookies: third-party cookies and pixels used to measure ad campaigns, build audiences, and show you relevant ads about Magic Marketer® on other platforms (for example Meta / Facebook and Instagram, and LinkedIn). These technologies may collect information such as pages you visit on our sites, interactions with our ads, and a hashed form of contact details you submit on forms (where advanced matching is enabled), so those platforms can match you to an account and attribute conversions.

Advertising and analytics tools are only activated after you consent via our cookie banner (or if you later change your preference). You can withdraw consent at any time by clearing site data for this domain in your browser, or by contacting us at grow@magicmarketer.app. You may also use browser controls or platform ad settings (for example Meta Ad Preferences or LinkedIn advertising settings) to limit interest-based advertising.

If you reject non-essential cookies, the site will still work; some analytics and advertising features will simply not run.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated to your registered email address with reasonable notice before they take effect.
